Man facing charges for living uninvited in apartment

A transient man is facing charges after he was found living uninvited in an apartment above a garage by a residence in Sugarcreek Borough.

Sugarcreek Borough police said in a criminal complaint a property owner on Nesbit Street in Rocky Grove told police on Tuesday that an unknown male, later identified as Alex Attleberger, 18, had been living in his garage, which has an apartment in the upstairs of the garage.

The property owner told Attleberger to leave and not come back, the complaint said.

On Wednesday, the property owners again found Attleberger on their property and told him to leave, the complaint said.

Then on Friday at about 11:45 a.m. police made contact with Attleberger who was seen walking in Rocky Grove on Gilfillan Street, according to the complaint.

After he identified himself, Attleberger admitted to police he had been staying in the garage apartment and using the garage as a bathroom because he is homeless, the complaint said.

Attleberger was also identified by one of the people associated with the garage he had been staying in, the complaint said. The complaint notes that the lock on the garage was found to be broken off so a person could enter the apartment area.

Attleberger is facing felony charges of burglary-overnight accommodation, no person present and criminal trespass-enter structure and misdemeanor counts of criminal mischief-damage property and defiant trespass.

He was arraigned Friday and placed in the Venango County jail after being unable to post bail, and his preliminary hearing is scheduled Wednesday in Central Court.
