Vehicular homicide charge filed against road worker

A criminal complaint filed through District Judge Patrick Lowrey’s office said 57-year-old Michael Brown of Guys Mills was cleaning the roadway with a rotating broom on a John Deere skid steer in the eastbound lane of Bredinsburg Road on Oct. 4, 2016.

Brown, who was working for Clint Brown and Sons Inc. of Guys Mills, created a hazardous dust cloud on the roadway with the sweeping, according to the complaint.

At the same time, William Moon Jr., 55, of Oil City, was traveling on the road near Black Beary Lane in Cranberry Township on a 2006 Harley Davidson when he struck the skid steer from behind, the complaint said.

Moon was ejected from his motorcycle and struck a bar mounted on the back of the skid steer with his head, the complaint said.

After impact, Moon became partially lodged under the motorcycle, according to the complaint.

The skid steer continued to travel east for a short distance after being struck by the motorcycle, the complaint said. Brown did turn the vehicle around and returned to the area of impact, according to the complaint.

Authorities at the scene transported Moon to UPMC Northwest where he was pronounced dead as a result of his injuries.

Brown suffered no injuries in the collision.

It was determined that Brown had failed to erect work zone safety signs to warn motorists entering the area of maintenance work being done, the complaint said.

Brown is facing a felony count of homicide by vehicle and misdemeanor counts of involuntary manslaughter and recklessly endangering another person. He is also facing two summary counts related to work zone notification failure.

An arraignment is scheduled Sept. 1 before Lowrey
